1. Who can use DigitalMarket

You must be at least 18 years old (or the age of majority in your jurisdiction) and have legal capacity to enter binding contracts. By creating an account, you represent that you meet these requirements.

2. Account responsibility

• You are responsible for all activity under your account. Keep your password secure and enable Two-Factor Authentication (2FA) — strongly recommended for sellers.
• You must provide accurate information at registration and keep it current.
• One person, one account. Multiple accounts created to circumvent suspension or manipulate reviews will be terminated.
• We may suspend or terminate accounts that violate these Terms, with or without notice.

3. Buying digital products

• All sales are between you (buyer) and the individual seller. DigitalMarket is a marketplace, not the merchant of record.
• Pricing is set by sellers. Prices shown are in Egyptian Pounds (EGP) by default; the currency switcher converts for display only — settlement is in EGP.
• For card payments, your order is confirmed and your download link (valid for 30 days) is issued automatically as soon as Kashier confirms the payment. For InstaPay, the link is issued after an admin approves your uploaded payment proof. Re-download until expiry.
• License keys (when issued) are unique to your order. Sharing them violates these Terms.

4. Refund policy

Refunds are available only before you download. Because products are digital and cannot be returned, an order becomes final and non-refundable the moment any file in it is downloaded. While an order is still un-downloaded and within 7 days of approval, you may request a full refund for any reason via the Request Refund button on My Orders (it disappears after your first download).

Refunds are reviewed by admin within 5 business days. Approved card refunds are returned to your card through Kashier (per Kashier's refund handling) and post to your statement within the issuer's window — typically 7–14 business days. InstaPay refunds appear within 5–10 business days. Full details are in our Refund & Cancellation Policy.

After download: the order is non-refundable. If a downloaded file is genuinely defective, materially not as described, or pirated, contact support within 7 days — our team may still issue a refund at its discretion (Egyptian Consumer Protection Law).

5. Selling on DigitalMarket

• You must own (or have legal rights to sell) every product you list. Pirated, counterfeit, or trademark-infringing products result in immediate account termination and possible legal action.
• Commission structure: 5% platform fee by default, dropping to 4.5%/4%/3.5%/3%/2.5% at the Silver/Gold/Platinum/Diamond/Legend creator tiers based on lifetime sales.
• Sellers with lifetime sales over EGP 1,000 must complete KYC verification (National ID + selfie + address). Documents are stored encrypted, reviewed only by admin, never shared.
• You are responsible for collecting and remitting applicable taxes (Egyptian VAT, income tax). DigitalMarket does not deduct taxes on your behalf.
• Egyptian e-Invoice (ETA) integration is the seller's responsibility for B2B sales above the registration threshold.

6. Prohibited content & Acceptable Use Policy

DigitalMarket is a marketplace for legitimate licensed digital products and educational content only. The following are strictly prohibited; any listing violating these rules will be removed without notice and the seller's account may be permanently disabled and reported to the relevant authorities.

6.1 — Social media engagement & "SMM" services (strictly forbidden)

You may NOT list, sell, or solicit the sale of:

• Followers, fans, friends, subscribers, members, or any other "social proof" metric for Instagram, TikTok, Facebook, YouTube, X/Twitter, LinkedIn, Telegram, Snapchat, or any other platform;
• Likes, hearts, claps, reactions, comments, shares, retweets, reposts, or saves on any platform;
• Views, watch-time, plays, listens, or impressions on any platform;
• "SMM panels", reseller dashboards, or API access to engagement-generation services;
• Vote-stuffing, poll manipulation, or contest-rigging services;
• Verification-badge ("blue tick") services, account recovery for accounts you do not own, or any service that requires sharing of platform credentials.

6.2 — Other forbidden categories

• Content that infringes copyright, trademark, or any other intellectual property right (use the DMCA form to report violations);
• Software containing malware, ransomware, spyware, keyloggers, or unauthorized tracking code;
• Cracked, nulled, or pirated software, courses, e-books, plugins, or design assets;
• Pornography, sexually explicit content, escort services, or any adult material;
• Violence, hate speech, terrorist content, or content harmful to minors;
• Gambling, betting tips, lottery systems, or "guaranteed winning" schemes;
• Drugs (including prescription medication), weapons, ammunition, or explosives — physical or digital instructions;
• Personal data, leaked databases, hacked accounts, stolen credit cards, identity documents, or KYC bypass services;
• Fake reviews, paid testimonials, or astroturfing services;
• Cryptocurrency pump-and-dump signals, Ponzi/MLM enrollments, or unregistered investment advice;
• Services or content prohibited by Egyptian law, including the Telecommunications Regulation Law and the Anti-Cyber Crime Law (Law No. 175 of 2018);
• Listings that are misleading about their content, file format, deliverables, or licensing terms.

6.3 — Enforcement

Violations of this Acceptable Use Policy will result in immediate listing removal and, depending on severity, account suspension, permanent ban, refund of affected buyers from the seller's balance, and (where applicable) reporting to the National Telecom Regulatory Authority (NTRA), the Public Prosecution, or the payment processor's fraud unit. DigitalMarket cooperates fully with law-enforcement requests issued under Egyptian law.

7. Reviews and ratings

• Only verified buyers (with an approved order containing the product) may post reviews.
• Reviews must be honest, based on personal experience, and not contain personal attacks, advertising, or off-topic content.
• Sellers may not incentivize, manipulate, or buy reviews.
• DigitalMarket may remove reviews that violate these rules.

8. Payments and payouts

• Buyers pay via the methods shown at checkout: debit/credit card (Visa, Mastercard) and InstaPay.
• Card payments are processed by Kashier, our licensed third-party payment service provider, through Kashier's secure, PCI-DSS-compliant hosted payment page. DigitalMarket never sees, handles, or stores your full card number, expiry, or CVV. When you pay by card you also agree to Kashier's Terms of Use, Privacy Policy, and Acceptable Use Policy.
• Card orders are confirmed and the download is delivered automatically the moment Kashier confirms a successful payment. InstaPay orders are reviewed and approved by an admin after the buyer uploads payment proof.
• Card refunds are returned to the original card through Kashier, in line with Kashier's refund handling and our Refund & Cancellation Policy.
• Sellers receive payouts after the order is approved AND the 7-day refund window expires.
• DigitalMarket retains the agreed commission on each approved order.
• Loyalty points earned (1 point per EGP spent) may be redeemed for discounts at checkout.

9. Affiliate & referral programs

Buyers can share referral links and earn 5% commission on first orders from referred users (paid monthly). Sellers may opt into the affiliate program with a self-set commission rate. Fraudulent referrals (self-referrals, fake accounts) forfeit all earnings and may result in account termination.

10. Intellectual property

You retain ownership of products you upload. By listing on DigitalMarket, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and promote your products through the Service. The DigitalMarket name, logo, and platform code are owned by us.

11. Disclaimers

The Service is provided "as is" without warranties of any kind. We don't guarantee uptime, error-free operation, or that any specific product will meet your needs. Sellers — not DigitalMarket — are responsible for the quality, legality, and accuracy of their products.

12. Limitation of liability

To the maximum extent permitted by law, DigitalMarket is not liable for indirect, incidental, consequential, or punitive damages. Our total liability for any claim shall not exceed the total fees you paid to us in the 12 months preceding the claim.

13. Dispute resolution

These Terms are governed by the laws of the Arab Republic of Egypt. Any dispute that cannot be resolved through good-faith negotiation shall be submitted to the competent courts of Cairo, Egypt. Alternatively, both parties may agree to arbitration under the rules of the Cairo Regional Centre for International Commercial Arbitration (CRCICA).

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via email to your registered address at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
